The SEC issued a Staff No-Action letter on March 24, 1998 assuring that if a program met five criteria, they would not recommend enforcement action for advertisements under Section 206(4) of the Investment Advisors Act of 1940 and Rule 206(4)-1(a)(1). The Women’s Choice Award Advisors Program meets these five criteria.
An advisor who is included on the Women’s Choice Award Financial Advisors listing may pay an additional fee that provides the advisor with an expanded listing and profile as well as full licensing of the Award for use on their website, marketing materials and advertising. In its No-Action letter, the SEC Staff put forth eight points that should be considered when determining whether any advertisement is a testimonial that is false or misleading.
